4. PRICING POLICY

The pricing policy of YummyChopps are based on fresh procurement changes that happens in the markets every day and decided by MSD Farms Private Limited. The prices displayed in our website for our products are always excluding GST and GST will be added to your invoices as applicable by the GST statutory of the Govt. of India.

The gross and net weight specified for our products have to be viewed with the specific variation of the product and the cleaning process. There could be deviations of a few grams from the net weight owing to the process of cleaning and cutting. Pricing will be applied as provided in the product variant display on gross / net weight.

The pricing may also contain delivery and handling charges as appropriate if chosen to be part of the price and if levied the details will be provided in the invoices sent to you.

5. INVOICING POLICY (BILLING)

Every order of yours will be serviced with prior invoicing and no services will be provided without any invoice from MSD Farms Private Limited. The invoices will be based on the prices that were displayed during your ordering process and products are added to the shopping carts and additional GST as applicable for the product as per statuette.

6. ORDER CANCELLATION PROCESS

You can opt for cancelling any of your orders placed by using the order cancellation facility of our website or calling to our customer service number given in our website before the order had been taken for packing. You will not be allowed to cancel your order if the order status is “Packed” or “In Transit” or “Delivered”. On cancellation, you will be receiving your refunds if payment had been received in advance for your order.

MSD Farms also reserves it’s right for cancellation of any order if any fraudulent transaction is suspected or any breach of terms and conditions.

7. REFUND POLICY

You can ask for a return and refund or your order, if you are not satisfied with the freshness or quality of our supplies. MSD Farms Private Limited are committed to satisfy every customer and your feedback will be treated with utmost seriousness. The return of the product to be intimated to our Customer Care number within 1 hour of receiving our supply

The returned supplies will be immediately checked for quality and any adulteration. If the claim is found valid, it will be refunded within 1 working day if you had paid in advance. The refunds may be adjusted with your next order if the order value is less than INR 500. In case of any differences on your claim on our checks, we will inform you within the same time frame and will be mutually resolved.

The supply of goods that our website offers are perishable and we advise you to read the instructions clearly on the packaging of our product and use these instructions accordingly as appropriate.

8. WRONG ADDRESS OR WRONG INFORMATION PROVIDED

Please be informed that in case of any rerouting of our services towards delivering our supplies due to any wrong address / wrong information provided by you during the registration / ordering process will incur additional charges as appliable to reroute our delivery.

9. COLOURS, PICTURES AND OTHER MEDIA USED IN OUR WEBSITE

The pictures and other media like videos, graphics used in our website are proprietary and not to be reused or downloaded for any commercial purposes. It is also advised that the colours and pictures used in our website are indicative and the actual colours and looks of our supplies may have variations as applicable for our sources of supply.

10. LAW AND JURISDICTION

All disputes arising out of any business transactions done with MSD Farms Private Limited and the customer shall be amicably settled by discussions and mutual consent. In case of the disputes not settled, the course of arbitration may be taken up in compliance with the applicable laws and the proceeding shall be held at Chennai and in English language.

The liability of MSD Farms Private Limited is with respect to the use of this website, products, offers. Any breach of this agreement is solely limited to the amount that you had paid for the transaction for any claim arising there forth.

11. INDEMNIFICATION

You will release, indemnify, defend and hold harmless MSD Farms Private Limited and any of it's contractors, agents, employees, officers, directors, shareholders, affiliates and assigns from all liabilities, claims, damages, costs and expenses, including reasonable attorneys' fees and expenses, of third parties relating to or arising out of

• Infringement of any intellectual property or other proprietary right of any person or entity including MSD Farms Private Limited, by you; or
• Any information or data provided to MSD Farms Private Limited by you. When MSD Farms Private Limited is put at risk with suit or sued by a third party, MSD Farms Private Limited may seek written assurances from you concerning your promise to indemnify MSD Farms Private Limited
• Any failure to provide such assurances may be considered by MSD Farms Private Limited to be a material breach of this Agreement.
• MSD Farms Private Limited will have the right to participate in any defence by you of a third-party claim related to your use of our website, products or offers, with a counsel of MSD Farms Private Limited’s choice at its expense.
• MSD Farms Private Limited also will reasonably cooperate in any defence by you of a third-party claim at your request and expense
• You will have sole responsibility to defend MSD Farms Private Limited against any claim, but you must receive prior written consent from MSD Farms Private Limited regarding any related settlement. The terms of this provision will survive any termination or cancellation of this Agreement or your use of the our website or products.

12. FORCE MAJURE

MSD Farms Private Limited will not be deemed in default hereunder or held responsible for any cessation, interruption or delay in the performance of it's obligations hereunder due to any unforeseen events like earthquake, flood, fire, storm, natural disaster, act of God, war, terrorism, pandemic, lockdown conditions, armed conflict, labor strike, lockout, or boycott.

13. CESSATION OF OPERATIONS

15. Normal Delivery Timelines

The normal delivery timelines for shipping the products ordered by the customers of MSD Farms Private Limited will be within 120 minutes from the order placement. While round the clock delivery is available for customers to order till 7:00 PM, the operational time period for deliveries will be morning 07:00 AM to 12:00 Noon, mostly and if required in the evenings as required by the orders placed.

16. Delivery Timelines of Scheduled Orders (Pre Orders – placed before a day)

Delivery timelines for scheduled orders that are received from customers as pre-orders placed day(s) prior to the delivery date expected will be within 09:00 AM in the morning of the expected delivery date.
